The Ministry of Transport, the day before the entry into force of the obligation, published the circular, specifying that the regulation implementing article 172 of the new Highway Code was published on 23 October in the Official Journal, providing for the entered into force 15 days later, precisely on 7 November 2019.
In reality, everyone expected the rule to come into force after 120 days, then in March. So there was a panic between those who have to do the checks and those who have to put in order. In addition, to facilitate the purchase of the devices, a fund for an incentive of 30 euros for each device purchased was set up in the tax authorities. But there is no decree from the Ministry of Transport indicating how to take advantage of the bonus. The measure will concern 1.8 million children living in Italy: only 250 thousand seats will be available for sale on the market between here and Christmas ...
Those who do not have these devices will incur the violations provided for by article 172 of the Highway Code, with an administrative sanction of 81 to 326 euros (payment within five days 56.70 euros) and the reduction of 5 points from the driving license. And after a kind of popular uprising, the Minister of Transport, Paola De Micheli, intervened directly: "I want to reassure mothers and families about the urgency of this device and about 'fines' for those who are not yet equipped with this tool: the ministry - explains De Micheli - that I represent is here for all the clarifications and there is the willingness of the government and the entire majority to intervene to postpone the application of the sanctions ".
