To ensure the safety of the driver and passengers, the law requires seat belts to be fastened. What many drivers don't know, however, is that the obligation also extends to passengers traveling in the rear seats.
The law requires what is reported in art. 172 of the Highway Code:
“It is mandatory for everyone, (drivers and passengers of vehicles), to fasten the seat belts on the front seats and (from 2006) also on the rear seats. The obligation is to use belts for adults and, as regards children of less than 1.50 m in height, to use approved restraint systems that are suitable for their weight."
In fact, this is a legal constraint that has existed for almost 15 years but is still largely overlooked today.
According to the data, the correct use of seat belts could avoid a figure that is around 300 cases of victims per year caused by poor safety in the car.
Accidents and accidents are more and more frequent and the cause of all this is due to the numerous infractions committed while driving, including in first place, the exceeding of the speed limits imposed by law.
To protect and encourage car safety, the penalties for those who commit infractions while driving are increasingly severe.
The Highway Code, as regards fines, in art. 172 establishes that anyone who does not wear seat belts or tampering correctly is punished with a penalty ranging from € 81 to 326, with a reduction of five points from the driving license. If he is fined again within two years, the license suspension is canceled from 15 days to two months. If it is not connected by a minor, the driver is liable for the violation.
The failure to use the seat belts, in addition to endangering the safety of those inside the car in the event of an accident, is subject, as already mentioned, to an administrative sanction, not to be underestimated, furthermore, the possible consequences in terms of 'RC car. "In the event of damage to the persons transported, if the absence of the use of seat belts is ascertained, the insurance company may not reimburse or apply the right of recourse for" transport carried out in the absence of compliance with applicable laws. In addition, even in the event of compensation, this could be reduced if the lack of use of the belts contributed to aggravate the damage suffered. ".
The use of rear seat belts is mandatory in any case, both for passengers traveling in taxis and also on rental cars or chauffeur driven cars.
